"The convict repeatedly hit the victim with a stone on his head resulting in his death. In this way, the convict acted in a most cruel manner," Special Judge Narinder Kumar said while also imposing a fine of Rs 10,000 on Uttar Pradesh -native Ashok Bind.
Bind was held guilty of murdering Karnataka resident Uday Kumar.
According to the prosecution, Kumar had come to Delhi to take an examination for Delhi Subordinate Services Selection Board (DSSSB). The incident occured night of June 9-10, 2013 when Kumar was sleeping on a bench at the station while waiting for the train to start for his native place.
Since Kumar was already asleep and Bind insisted on sleeping on the same bench, a quarrel took place between the accused and the victim's friend, it said, adding that Bind took a stone and repeatedly hit Kumar who was sleeping, resulting in his death.
Bind was caught on the spot and arrested by the police. Kumar was taken to a nearby hospital where he died.
During trial, Bind admitted that he was present at the spot but denied committing the offence. He also sought leniency in the sentence while submitting that he did not intend to cause Kumar's death.
"Furthermore, as per oral and medical evidence, the accused repeated blows with the stone on the vital part of the body of the sleeping passenger. Thus, he acted in cruel and most unfair manner," the court said while holding Bind guilty of murdering the victim.
