Additional Sessions Judge (ASJ) Suresh Kumar Gupta let off BJP councillor Anil Sabarwal of Milap Nagar in West Delhi, saying power distribution company BSES Rajdhani had failed to prove that he had indulged "in theft of electricity."
"The evidence on the file is not enough to connect the accused (Anil) with the commission of crime. The complainant (BSES Rajdhani Power Ltd) has failed to prove that accused was indulging in theft of electricity for the use of inspected premises.
"I have no hesitation to hold that complainant company has failed to bring home the guilt against Anil beyond shadow of reasonable doubt and accordingly accused is acquitted of the offence charged," ASJ Gupta said.
