MACT presiding officer Madhu Jain asked HDFC Ergo General Insurance Company Ltd, insurer of the truck, to pay Rs 8,87,384 to the wife and four children of south-Delhi resident Hasmuddin.
"Petitioner has been able to prove that deceased suffered fatal injuries due to rash and negligent driving of the respondent no.1 (driver)," the tribunal said.
It noted that at the time of the accident, the victim's age was 34 years and he was a tailor and earning Rs 6,422 per month.
According to the complaint, on April 16, 2011, Hasmuddin along with one other person was going on a motorcycle from Aligarh to Hathras in Uttar Pradesh when suddenly the offending truck, driven in rash and negligent manner, hit him.
Due to the impact, he fell down on the road and suffered grievous injuries.
The insurance firm, however, denied the claim saying that the offending vehicle was not insured with it at the time of accident.
Driver and the owner of the vehicle did not appear before the tribunal and were proceeded ex-parte.
