The National Green Tribunal has issued showcause notice to 10 residential colonies of Agra for discharging untreated sewage and asked them to explain why a fine of Rs 1.41 crore be not imposed on them for polluting river Yamuna.
A bench headed by NGT Chairperson Justice Swatanter Kumar issued notices to Indradhanush Colony, Rahul Vihar, Sant Nagar, Jai Ram Bag, Rahul Green, Tulip Paradise, Amar Vihar, Maitri Bag, Friends Vihar and Radhavallabh Inter College of Agra.
"Notice be issued to all the builders and resident welfare associations of the said colonies. Notice will be served through the concerned resident welfare associations, if they exist or through the concerned builder/Developers, or alternatively in the representative capacity.
"Noticees will have to show cause why compensation upon them be not imposed for polluting environment particularly river Yamuna, and they should not be directed to pay a sum of Rs. 1.41 crores as expenditure to be incurred by authorities for connecting their sewage to the STP," the bench said.
Uttar Pradesh Jal Nigam and Agra Development Authority told the Tribunal that there was an unauthorized outlet for discharge of sewage directly into the river Yamuna in the vicinity of Amar Vihar Colony and they have demolished the outlet of pipeline.
The authorities further informed that they have also closed the three manholes on way to this outlet to ensure that no discharge flows through the said pipeline directly into the river00.
During the hearing, Agra Development Authority told the bench that there has been indiscriminate and unauthorized dumping of construction waste by the builders in Yamuna and they have issued notice to and imposed fine on five of them.
"Issue notice to all these parties to show cause why compensation in terms of Section 15 and 17 of National Green Tribunal Act, 2010 be not imposed upon them and why appropriate directions be not passed in relation to their structure which are violative of environmental laws," the bench said.
Earlier, the Tribunal had imposed a fine of Rs 1 lakh on Agra Municipal Corporation for dumping of waste on the floodplains of river Yamuna in the city, noting that the civic body has failed to perform its duty and protect the environment.
