New cost norms to aid accurate checks on predatory pricing, says CCI chief

Amidst concerns and complaints over predatory pricing ways, Competition Commission chief Ravneet Kaur on Tuesday said the new cost of production norms will help in having more accurate and objective assessment for easier enforcement outcomes. Speaking at the function to mark the 16th Annual Day of the Competition Commission of India (CCI) in the national capital, she also said that digital markets see rapid change and the first mover advantage gets concretised very quickly. "We have the possibility of algorithmic decision-making and self-preferencing by those having the first mover advantage," she said. CCI seeks public comments on draft rules for determining cost of production

The Competition Commission of India (CCI) on Monday released the draft rules for determination of cost of production, seeking to update its framework for assessing predatory pricing under the competition norms. This will replace the existing norms set in 2009. Under the rules, Section 4(2)(a)(ii) prohibits predatory pricing as an abusive conduct by a dominant enterprise. Further, the law defines "predatory price" as the sale of goods or provision of services at a price below the cost -- as determined by regulations -- with the intent to reduce competition or eliminate competitors. The draft CCI (Determination of Cost of Production) regulations, 2025, were issued under section 64(2)(a) of the Competition Act, 2002, which empowers the regulator to prescribe cost benchmarks for assessing anti-competitive practices. Panel on digital competition law likely to finalise report by May-end

The government-constituted panel on digital competition law has completed stakeholder consultations and is likely to finalise its report by the end of May, according to senior officials. The panel, chaired by Corporate Affairs Secretary Manoj Govil is examining various regulatory aspects in dealing with challenges emerging from the digital economy. It is also looking at the need for an ex-ante regulatory mechanism for digital markets through a separate legislation. The panel members will discuss various aspects as well as the inputs of stakeholders before finalising the report, the officials said on Thursday. They said the consultations with stakeholders have been completed. The panel was set up by the corporate affairs ministry in February, less than two months after a Parliamentary panel proposed having a new digital competition law to curb anti-competitive practices in the digital markets.
