British millionaire Shrien Dewani may be allowed to walk free if the court annuls the charges against him after the state formally closed the case against him, a report said.
Dewani's counsel, Advocate Francois Van Zyl, had told the court last week that he would be applying for a discharge and acquittal of the accused. The application will be argued before Deputy Judge President Jeanette Traverso, reported Sky News.
Although the grounds of seeking an acquittal will be revealed only after it is read out in court yet legal experts believe that it will be based on the grounds that the state failed to prove its case against Dewani.
A legal expert said that after three weeks and 19 witnesses called by the state, there was nothing that could link Dewani to his wife, Anni Dewani's murder.
If the application is accepted by the court, the case will be closed and Dewani will be declared not guilty.
However, if the application is denied then the defence will have the opportunity to summon witnesses, including Dewani, to the stand.
