Aarushi case: CBI theory on blood stains taken apart

In the Aarushi-Hemraj double murder case, the defence lawyer, arguing for the Talwars in the CBI court here, Wednesday effectively contradicted the CBI theory that blood stains were found on the staircase.

In their defence, the Talwars' lawyer Satyaketu Singh submitted that out of seven Central Bureau of Investigation (CBI) witnesses, including the maid, Bharti, and six police officials, not one had mentioned the blood stains on the staircase.

Even the polygraph test by scientist A.D. Shah did not indicate blood stains on the staircase, the lawyer said.

The lawyer said the CBI then produced two witnesses, then city magistrate Sanjay Chauhan and one man named Rajiv Kochar.

The defence lawyer argued that Chauhan could not be relied upon since he had claimed that he would arrive for a morning walk daily from Greater Noida, travelling a distance of 56 km both ways.

The lawyer also pointed to the fact that though the CBI claimed to have conducted a dummy test, carrying the dead body to the terrace by two men, and recording the act in video and still photographs, none of these were produced in court.

The lawyer wondered if that meant that the dummy test did not justify earlier claims.

The lawyer also said that the CBI did not produce the cloth in which it claimed that the dead body was carried.

He asked why, if a pool of blood was found on the rooftop, no blood stains were left on the staircase. The lawyer said the CBI also did not mention if stains had been washed off the staircase.

After the hearing of the arguments of the defence lawyer, the CBI judge adjourned the court to Nov 7.

Fourteen-year-old Aarushi, the only child of the dentist couple Talwars, residents of Noida, was found murdered in her parents' home May 16, 2008. The body of Hemraj, a domestic help, was found the next day on the terrace of the house.
