DCW chief's appointment lacks legal sanctity: Jung

Delhi Lt. Governor Najeeb Jung has disapproved of the appointment of Swati Maliwal as the new Delhi Commission for Women (DCW) chief, saying it lacked "legal sanctity".

"...all statutory notifications for the reconstitution of the DCW in the past had the approval of the Lt. Governor of Delhi. As the notification in question has been issued without the Lt. Governor's approval, the competent authority, in breach of rules and procedures, the notification has no legal sanctity and any action taken by the chairperson or any member of the Commission, including quasi-judicial decisions, would be ultra vires and infructuous," Jung wrote in a letter to the Delhi government on Tuesday.

Maliwal, however, said she had not received any formal communication with regard to the disapproval. "There could be a few technical glitches but I have not received any formal communication yet."

Maliwal, an RTI activist and wife of AAP leader Naveen Jaihind, took charge as the chairperson of DCW on Monday.

An official at the Lt. Governor's office said here on Wednesday that the Aam Aadmi Party government did not take his approval before appointing Maliwal.

AAP leaders Sanjay Singh, Kumar Vishwas and Ashutosh will meet the Lt. Governor at 5 p.m. on Wednesday to discuss the issues of Swati Maliwal and party leader Dilip Pandey, who accused police of trying to run him over outside a police station on Tuesday night.

Najeeb Jung and the Aam Aadmi Party government were earlier involved in a public spat over the posting and transfer of senior government officers in the national capital.
