Arunachal to issue NOC to govt staff on encroaching land

They encroached on government land and accommodation after recovering appropriate fee

The Arunachal Pradesh government has decided to issue No Objection Certificate (NoC) to government employees who have encroached on government land and accommodation after recovering appropriate fee.

A recent meeting chaired by chief secretary Ramesh Negi decided that the chief estate officer (CEO) and the land management director would prepare a category-wise list of encroachers along with a list of encroachment cases pending before courts.

The UD & housing director were directed to write to banks and other head of departments to stop issuing building loans to anyone without an NOC, official sources said.

It was decided that charges as per the Arunachal Pradesh Premises Act, 2003, and other relevant laws would be recovered from encroachers as long as the matter of regularizing encroached land or accommodation was pending.

"The encroachers will also be liable to pay for damages or misuse of government property from their pension and gratuity," the sources said.

The CEO has been empowered to remove and prevent unauthorized construction. The period of show-cause notice to encroachers would be 24 hours in place of 10 days and in the matter of ongoing encroachment no notice would be required to hold and demolish such structures, the meeting decided.

In case departmental proceedings have been initiated with regard to land encroachment or major damages to government accommodation, the retirement gratuity of the encroacher in question is liable to be held up till the conclusion of the proceedings, the sources said.
