Dismissing the revision plea filed by accused Prashant and Rohit against trial court's November 9, 2012 order, Justice Sunil Gaur said, "Finding no illegality or infirmity in the impugned order, this petition is dismissed."
The youths in their appeal filed through counsel Sugam Puri said, "The petitioners are innocent persons and have been falsely implicated in this case only because they are friends of one of the accused Anil Raj."
In the plea, the two youths contended that the attempt to murder charge was falsely levelled against them as "it was a clear case of sudden quarrel which has been given colour of attempt to murder".
All the four accused were charged with assaulting and obstructing public servants (judges) from discharging their duties, criminal conspiracy and rash and negligent driving under sections 186, 353, 120B and 279 of the IPC, besides attempt to murder.
".... The two persons on the motorcycle flew into a rage and they made Lal, the driver, step out of the car.
"They began abusing him. When Lal got back into the car, the bikers picked up stones that were lying by the roadside and began hurling them at the car," the police said.
Metropolitan Magistrate Ajay Garg and car driver Chaman Lal suffered head injuries, while Additional Sessions Judge M K Nagpal and Additional District Judge Inderjeet Singh Mehta, who were also in the car, escaped unhurt.
"Lal suffered minor injuries, while Garg was admitted to AIIMS," the FIR said.
