According to sources, Berry's lawyer will ask Martinez about his experience with paparazzi in Paris to which the actor will reply saying "The photos are far more respectful and less aggressive in Paris than their counterparts in the USA."
Martinez will also discuss their living arrangement and his involvement with Nahla. He will also tell the judge that Berry is a good mother, reported TMZ Online.
Berry and Aubry have been battling in court over custody of their four-year-old daughter, Nahla, as the Oscar-winning actress is seeking to move the child with her to Paris out of concerns for their safety.
She filed a request in family court for permission to move to France but the child custody report recommends that Nahla "shouldn't be separated from her father."
