Advocate Sachin Shetye, appearing for Kapoor, informed a division bench of Justices R V More and Anuja Prabhudessai that the choreographer and the victim - Nisar Noormohammed (37) - and his family have arrived at a financial settlement and hence sought the case to be quashed.
"We are seeking quashing by consent. Soon after the accident, Kapoor took the victim to Kokilaben Hospital and made sure that he was treated. The victim suffered one fracture on his right knee. Kapoor has borne his medical expenses which has till date summed up till Rs seven lakh. She has given the victim additional Rs three lakh in cheque," Shetye told the court.
The High Court, however, was not satisfied and queried if the Rs three lakh amount was sufficient. The court then asked Nisar, who was present in court on a wheelchair, if he and his family are happy with the settlement amount.
Nisar, however, told the court that the amount will not suffice as he is out of work since the accident in March this year. "I am an electrician by profession. Since the accident, I am sitting at home. I have two children to look after. The lady (Kapoor) has paid for my medical expenses but I am not satisfied," Nisar told the court.
On March 12 this year, 42-year-old Kapoor was arrested after her Sedan knocked down Nisar who was crossing the road at suburban Versova. Kapoor did not flee from the spot and took the victim to hospital.
She was later called to police station and arrested for rash and negligent driving and causing hurt to another person. She was released on bail later.
