Court frees man of charges of sexually assaulting minor girl

A Delhi court has acquitted a man of the charges of sexually assaulting and threatening a 17- year-old girl after she resiled from her statement.
Additional Sessions Judge Gautam Manan absolved Delhi resident Sachin, saying there was no evidence to establish the committal of the offences under section 8(sexual assault) of Protection of Children from Sexual Offences (POCSO) Act and under sections 354(molestation) and 506(criminal intimidation) ofthe IPC.
"There is no evidence to establish that the prosecutrix (girl) was either stalked, assaulted or threatened by the accused. The allegations against the accused are not proved," the judge said.
The court noted that the girl, a student of Class XI, told the court that on the date of incident she had a quarrel with the accused and for that reason she lodged the complaint.

"She categorically deposed that the accused did not stalk her nor did he assault her. Even the prosecutrix was medically examined but no injury was found on her. Thus, there is also no medical evidence to establish that prosecutrix was sexually assaulted by the accused," it said.
According to the prosecution, an FIR was lodged on the girl's complaint alleging that Sachin had been stalking her and on July 11 last year, when she was going for tuition, he confessed his feelings to her and misbehaved with her when she rejected him.
The accused also threatened to assault her with a blade, it said, adding that she ran home and narrated the incident to her mother after which a complaint was lodged against him.

After the charges were framed against him, the accused had pleaded not guilty and claimed trial.
