The court said since it was a case of obtaining fake permission in 'no entry zone' purportedly under the signature of the additional commissioner of Delhi traffic police, "it was a matter of serious concern, if such kind of permissions are freely forged and were being used by commercial vehicles".
"In fact, such permissions are issued after examining their impact on the traffic during peak hours by the concerned traffic regulating authorities. Moreover, custodial interrogation of the applicant (woman) would be required as to from where she procured the fake 'no entry' permission.
Delhi resident Sangeeta Arora, owner of the vehicle, had sought anticipatory bail in a case of rash driving, cheating, forgery, using forged documents as genuine under the IPC which entails a maximum punishment of seven years if found guilty.
The incident took place on April 19 when the traffic police tried to stop a speeding car which was being driven rashly in Central Delhi's Rajinder Nagar. Driver of the heavy vehicle, however, fled and is absconding, police told the court.
The woman's counsel claimed she was falsely implicated and there was no reason for her to obtain a fake permission for entry of the vehicle.
The defence counsel claimed that the driver had asked the cops to give him the receipt of a challan to show it to the owner but they did not issue it and implicated the owner.
The prosecutor had opposed the woman's anticipatory bail application on the ground that the owner of the vehicle was not cooperating in the probe and the driver was also absconding.
