Court rejects bail pleas of two accused in attack case

A local court today refused to grant anticipatory bail to two persons who have been accused of allegedly attacking the organisers of a social event at Rabodi in the city on November 4 over an old dispute.
Thane Sessions Judge S S Virkar, while rejecting the application filed by Irfan Noor Mohamad Khan and Mohamad Noor Sayeed, observed that the offence registered by them was of serious nature and hence they cannot be granted bail.
The Rabodi police in Thane had booked four persons, including the two applicants, under various sections of the IPC for attack during a medical camp.
According to the complaint filed by Zoheb Mobin Shaikh, the accused had beaten him and his friend Fahim Sayyed, who sustained serious injuries after being hit on his head.
While Syyed Tarbez was arrested in this connection, another accused Sajid Khan, is absconding.
Tarbez was remanded to judicial custody by the Chief Judicial Magistrate K N Gautam, who rejected his application for bail. The court relied on the medical report of the two injured.
Arguing on behalf of the complainants, lawyer Sunil Bhatia urged the court that as the offence was of a serious nature, offence under sections 307 (attempt to murder) should also be registered against the accused in addition to other IPC sections already applied in this case.
Assistant Public Prosecutor Ashok Khamkar opposed the anticipatory bail plea of the duo and told the court that their custodial interrogation was needed since one more accused is yet to be arrested.
