Custody of woman accused of killing Chilean MP is harassment:

Delhi High Court today held that not granting bail to a French woman facing extradition to Chile for her alleged participation in the 1991 killing of a Chilean senator, is "harassment" and the government should look into it.
"You (Ministry of External Affairs) look into it. It is harassment. The reason is that the offence has no impact on the country (India)... You should look into it," a bench of Justice Ashutosh Kumar said.
The judge also said "what is the fun in keeping the woman confined in jail. Can we not allow her free by imposing certain conditions?"
He, however, maintained that this was his personal opinion and Verhoeven Marie Emmanuelle's plea challenging her arrest, pursuant to a red-corner notice issued against her by the Interpol, could be heard after 15 days.
Once a special extradition court here, which was set up through a notification issued on May 18 by the Ministry, and its constitutional validity is under challenge before the division bench, this court should wait for the final order, the judge said.
"The notification has been challenged and is pending for consideration before the division bench. I deem it appropriate to wait for the order of the division bench," he said, adding that "unless that notification by which a special court has been designated to hear the present issue is set aside, I can not pass any order".
It, however, fixed the matter for July 20 and said the notification in question has taken away power of this court.
56-year-old Verhoeven, a French national, was arrested on February 17 in Uttar Pradesh while she was entering India from Nepal. She is alleged to have participated in the assassination of Chilean senator Jaime Guzman Errazuriz on April 1, 1991.
Appearing for her, senior advocate A S Chandhiok contended that bail be granted as the CBI has already carried out verification of the addresses of the people who would stand surety for her as well as the place where she would be staying.
CBI had carried out the verification on the court's direction of June 10.
