The Madras High Court today reserved its orders on permitting withdrawal of a habeas corpus petition filed by the mother of a caste Hindu girl whose Dalit husband's death remained shrouded in mystery.
The counsel for deceased Dalit youth Illavarasan's family opposed the plea for withdrawal of the petition and prayed that the court pronounce an order.
A division bench, comprising Justice M.Jaichandren and Justice M.M. Sundresh, reserved the orders after counsel for Divya's mother submtited since she had already given an endorsement to withdraw the petition, the matter should be treated as closed.
Opposing this, counsel for Ilavararasan submitted the court should pass a detailed order, taking into account the statements of Divya given in court and the subsequent developments.
The body of Ilavarasan was found near a railway track in Dharmapuri on July 4, a day after Divya said she would never return to him and preferred to live with her mother.
The love marriage of Illavarasan and Divya led to caste clashes in three villages of Dharmapuri district last year.
Her mother had filed the habeas corpus petition some months ago alleging her daughter was being kept confined by Illavarasan against her wishes.
Meanwhile, a team of psychiatric experts, deputed by the high court to counsel Divya and her family members, said she was in a positive frame of mind and wanted to pursue her education.
