Guj HC orders probe by IG on complaint against Tapi SP

The Gujarat High Court today ordered the Range Inspector General (IG) of Surat to investigate a journalist's complaint alleging wrongful confinement and intimidation by some police officers, including one out on bail in the Ishrat Jahan case.
Justice A J Desai ordered the officer to investigate the matter on the complaint by vernacular daily Gujarat Mitra journalist Shivnaresh Bhadauria against Tapi SP N K Amin and other police officials for alleged criminal intimidation and wrongful confinement over articles written by him.
The court asked filing of FIR against them as per Supreme Court's judgement in Lalita Kumar versus government of UP, according to which it is mandatory for the police to register an FIR on the basis of an information or complaint which discloses commission of a cognisable offence.
Bhadauria had moved the high court alleging the Range IG and police inspector of Vyara police station did not entertain his complaint in which he said that he was called by Dy SP Bhagirath Gadhvi to his office on July 10, where in the presence of SP Amin, he was threatened over a series of articles he wrote against the police.
They allegedly kept him in confinement for five hours and threatened to register a false case against him, he claimed.
He sought registration of FIR against Amin, Gadhvi and other policemen under sections 120 (concealing design to commit offence), 321 (voluntarily causing hurt), 342 (wrongful confinement), 506 (criminal intimidation) and then moved the high court after police refused to file FIR against him.
Amin was appointed by the state government as a SP of Mahisagar, then transferred to Vyara after he was released on bail in Ishrat fake encounter case.
He has also been to the jail in connection with the encounter of Sohrabuddin Sheikh, his wife Kauserbi, and Tusliram Prajapati, and was discharged in Sheikh encounter case by a special Mumbai court.
