A bench of Justice Mukta Gupta issued notice to Delhi Police and asked it to file a status report in the case.
The accused said he has been implicated in the case and is charged under special law Protection of Children from Sexual Offences (POCSO) Act, meant for minor victims.
He said that the girl was adult. However, the FIR said the victim was a minor at the time of the incident.
The consensual physical relationship has been termed as rape by the girl's parents, it alleged, added the school certificate of the girl in support of his claim.
The bail application said the trial court dismissed his bail plea saying the allegations against him were serious.
