A division bench comprising Justice T. Meena Kumari and Justice Chakradhari Sharan Singh passed the order on a Public Interest Litigation (PIL) filed by one Dhirendra Kumar last year.
In the petition, Kumar had alleged that scores of children died in Gaya and other parts of the state due to outbreak of encephalitis and the state government had done nothing to contain the disease.
Taking note of the matter, the court asked the health department to file a detailed report stating the action taken to control encephalitis in Bihar.
The matter will come up for hearing after four weeks.
