Justice R K Gauba declined to stop the counting in one of the wards, saying it would disturb the process in other wards as well.
The petitioner had sought direction to the government to stop counting of votes in ward no. 69 S, under North Delhi Municipal Corporation, for two days.
The petitioner, who had contested from this ward, said the CBI should conduct an enquiry into his allegation that the Congress candidate from there had cheated and bought votes by distributing liquor and money.
Petitioner D K Chopra, who fought as an independent candidate, said he had written to the returning officer to stop the counting but no action has been taken till date.
He had also alleged that a senior police officer of the area had joined hands with the Congress candidate in permitting the corrupt activity of buying votes with liquor and money.
Delhi'ites had voted in 270 out of the 272 wards of the three municipal corporations here on April 23 and the results are scheduled to be announced tomorrow.
