HC orders issue of bailable warrant against college management

The Madras High Court today ordered issue of bailable warrant against the Secretary and the Correspondent of Quaide Milleth College for Men here on a contempt petition by a woman.
The petititoner Selvi filed the contempt petition for not obeying an order passed by the court on July one last year to give her pay and various allowances without insisting on her non-employment certificate till a probe on her complaint of sexual harassment by the management was completed and a final order is passed in the disciplinary proceedings.
Justice K K Sasidharan directed the issue of the bailable warrant to the Secretary and the Correspondent of the College.

The internal complaints committee, which has been contemplated under the Sexual Harassment of Women at Work place (Prevention, Prohibition and Redressal) Act, 2013, has not been constituted by the college, she submitted.
Though she had lodged a complaint with the Chennai city Commissioner of Police on September 6, 2013 regarding the harassment, it was forwarded for investigation to the Assistant Commissioner of Police.
Thereafter, on the instructions of the ACP, an Inspector of Police had inquired from her and after such a probe she had been promised about action.

She alleged in her petition that the report lodged by her discloses the commission of an offence punishable under Sec 3(1)(x) of the Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act and Sec 354B IPC which are cognizable offences.

The inspector of police has been trying to close the case, she submitted.
She submitted that having failed in their attempt to persuade her to withdraw her complaint against the Principal and the Superintendent of the college, the management suspended her from service.
The order does not disclose any reason for her suspension.
Hence she approached the Court which gave a direction to the College on July 1, 2014 to pay her the salary till a final order is passed on the disciplinary proceedings, which was not obeyed by the College and hence she filed a contempt petition.
