HC suggests 'Badmashiyaan' producers to settle infringement

The Delhi High Court today observed that producers of Bollywood film 'Badmashiyaan' "have got nothing" in their favour to allow release of the movie this weekend and asked them to try for a settlement with Multi Screen Media (MSM) which has alleged copyright infringement by the film's makers.
MSM, the Indian subsidiary of Sony Entertainment Television, has alleged that VRG Motion Pictures Private Ltd's 'Badmashiyaan' is a copy of a Korean film 'Couples' as well as its own production 'Mango', that is yet to be released.
"Even if they (MSM) have got little, you (VRG) have got nothing. So how can I allow you release your movie? I think you (VRG) do not have a good case," Justice Indermeet Kaur said and suggested "see if a settlement can be worked out."
The judge also said "balance of convenience is in his (MSM) favour. I am inclined to pass order in his favour."
The judge also suggested VRG pay money to MSM and get its movie released.
The court was displeased over violation of its order not to air trailers or promotions of the movie and said,"You can't ignore court orders."
The observation was made after senior advocate Amit Sibal, appearing for MSM, said the court's February 10 order not to air trailers of 'Badmashiyaan' has been violated as promotions of the movie was aired yesterday also.
Sibal said payment of some compensation to MSM may not work as its loss cannot be computed and suggested that 'Badmashiyaan' be released after 'Mango'.
This suggestion was also put to VRG for its consideration by the court which asked both sides to inform it tomorrow whether a settlement is possible, after which it will pass orders.
"Badmashiyaan," starring Suzanna Mukherjee, Sharib Hashmi, Siddhant Gupta, Gunjan Malhotra and Karan Mehra, was slated for release on February 27.
