HC takes serious view of on a petitioner

Madras High Court here today took serious view on a petitioner who filed a PIL in which he excluded a portion of the accolades laid for the work carried out by Environment and Forest Minister Thoppu N D Venkatachalam, but in the representation made to the Governor the accolades portion was intact.
The First Bench Comprising Chief Justice Sanjay Kishan Kaul and Justice M Sathyanarayanan was dealing with a PIL filed by one M Krishnasamy seeking a direction from the Court to take action against officials and the Minister who he said was allegedly involved in misappropriation of funds in the distribution of drought relief fund.
The bench after perusing the documents placed before it by the Counsel for the Minister, including a representation made by the petitioner on June 8, 2013 to Tamil Nadu Governor, in its order said "the afore said document has been filed to substantiate before the Court that in that letter to Governor, accolades have been laid for the work carried out by the Minister, while in the present plea allegations have been made against the Minister for benefitting only a part of his Taluk".
The bench said other representations are stated to have excluded this portion which praises the fifth respondent and issued on the same day.
"We consider the matter to be quite serious. We call upon the petitioner to file an affidavit stating as to whether the representation now filed was sent by him and the circumstances under which the wordings of two set of representations were different, while one praises the Minister".
The bench also directed the personal presence of the petitioner on November 5 apart from filing the affidavit.
Krishnasamy alleged in his petition that the minister has distributed the drought relief amount to his own relatives and the officials were colluded with the minister in the distribution of the fund. He also sought for an enquiry on the misappropriation of funds by CBCID Police.
Today when the matter came up for hearing it was brought to the notice of the Bench through a counter filed by the Minister that the petitioner who has sent a representation on the same issue to the Governor has praised him for the work done by him where as these portions were deleted in the typed set of documents filed with the Petition which amounts to suppression of facts to the Court.
The petitioner is a political opponent who lost to him two occasions in the Panchayat Board elections and the petition is filed only with political grudge against him, the Minister said in his counter.
