Illegal arms case: Court frees man over irregularity in probe

A man has been acquitted of the charge of possessing an illegal arm by a Delhi court which noted that there were irregularities in the police probe as the FIR was mentioned in police diary even before it was registered.
Additional Chief Metropolitan Magistrate Deepak Wason let off Delhi resident Rajesh of the charge after it noted that the irregularities in the police probe created "doubt" in the story of prosecution.
"It is admitted fact that recovery memo was prepared before the registration of the FIR. But perusal of recovery memo shows that FIR number is mentioned at the top of it.
"It is a surprising fact how the FIR number came at the top when the FIR was not registered at that time. No explanation has been given on this point," the court observed while acquitting the accused.
In its order, the court also noted that despite presence of public persons, no efforts were made by the investigating officer to join the them in the probe.
"I am of the considered view that the prosecution has miserably failed to prove the guilt of the accused beyond reasonable doubt," the court said.
According to the prosecution, on November 29 last year, the accused was found in possession of one country-made pistol without licence in Dwarka.
The accused was arrested and police filed the FIR under the provisions of Arms Act.
The accused, however, pleaded not guilty and claimed that he was falsely implicated in the case.
