Kin of Delhi Police constable get Rs 47 lakh compensation

The family members of a Delhi Police official, who died in a road accident after being hit by a rashly driven bus here, have been awarded a compensation of over Rs 47 lakh by a Motor Accident Claims Tribunal (MACT).
The tribunal directed National Insurance Company Ltd, with which the vehicle was insured, to pay Rs 47,05,330 to victim Arun Kumar Upadhyay's family including his wife, two kids and mother.
"It was noted that there is nothing on record to show that the petitioners (family) had any enmity with the driver of the offending vehicle so as to falsely implicate him in the case.

"The issue thus stands decided in favour of petitioners holding that the accident happened as a result of negligent driving by respondent no.1 (RTV bus driver) in which deceased (Arun) sustained fatal injuries," MACT Presiding Officer Ravinder Bedi said.
At the time of the incident, 39-year-old Arun was working as a constable with Delhi Police and earning over Rs 23,000 per month, his family submitted before the tribunal. The family members had sought a compensation of nearly Rs 80 lakh.
The family, belonging to Jharkhand, said in the petition that the incident took place on the morning of May 5, 2013 when Arun was crossing road near Kalyanpuri Police Station in East Delhi.

While he was crossing the road, an RTV Bus, driven by one Dharmender, in a rash and negligent manner and at a high speed, hit him, it said, adding that the victim fell down and suffered grievous injuries.

He was first taken to LBS Hospital and due to his critical condition and later referred to Max Balaji Hospital where he succumbed to his injuries on May 7, 2013.
A criminal case was also lodged against the bus driver at Kalyanpuri Police Station.
The bus driver and owner initially appeared before the tribunal but did not file their reply. Later, the tribunal proceeded ex-parte.
