The tribunal directed the driver and owner of the tractor, which was not insured, to pay the amount to the parents of the 15-month-old boy, who was crushed to death while sleeping outside his shanty in north Delhi.
"From the facts and circumstances and evidence on record it is clear that the tractor was being driven in a rash and negligent manner and it hit the child and caused his death," MACT Presiding Officer Manish Gupta said.
It also noted that the respondents (driver and owner of the tractor) failed to lead any evidence despite opportunities given to them.
According to the petition filed by Madhya Pradesh natives, Bhumani Das Ahirwar and his wife, their son was sleeping outside their shanty on the morning of July 28, 2004 near Mukherjee Nagar in north Delhi when the tractor crushed him to death.
The driver and owner of the tractor filed written statements but failed to appear before the tribunal during final arguments in the matter.
