Parents of a toddler, who was crushed by a rashly driven tractor, have been awarded a compensation of Rs five lakh by a Motor Accident Claims Tribunal (MACT) here.
The tribunal directed the driver and owner of the tractor, which was not insured, to pay the amount to the parents of the 15-month-old boy, who was crushed to death while sleeping outside his shanty in north Delhi.
"From the facts and circumstances and evidence on record it is clear that the tractor was being driven in a rash and negligent manner and it hit the child and caused his death," MACT Presiding Officer Manish Gupta said.
While directing the driver and owner to pay the amount of compensation, the tribunal relied on the post-mortem report of the victim, testimony of his father and the FIR lodged in the case.
It also noted that the respondents (driver and owner of the tractor) failed to lead any evidence despite opportunities given to them.
According to the petition filed by Madhya Pradesh natives, Bhumani Das Ahirwar and his wife, their son was sleeping outside their shanty on the morning of July 28, 2004 near Mukherjee Nagar in north Delhi when the tractor crushed him to death.
The driver and owner of the tractor filed written statements but failed to appear before the tribunal during final arguments in the matter.
