NDMC appointment: HC says no urgent hearing of AAP MLA's plea

The Delhi High Court today turned down a plea of an AAP MLA seeking urgent hearing of his appeal against a single judge order refusing to restrain BJP leader Karan Singh Tanwar from taking oath as Vice Chairman (VC) of New Delhi Municipal Council (NDMC).
The BJP leader was appointed as NDMC VC on July 8, by a government notification and is likely to take oath on July 20.
A bench of justices B D Ahmed and Sanjeev Sachdeva said since the single judge has already refused to give any interim order to petitioner and AAP MLA Surender Singh, there was no urgency in the matter which could come up for hearing in due course.
"Your humble request is humbly rejected. Let the matter come up on Monday (July 20)," the bench said.
Singh filed an appeal against the single judge's July 15 order saying "in my view, the grant of interim order would amount to granting the relief sought in the petition".
Singh's counsel had mentioned the appeal before the court twice and requested for hearing today, which was declined.
The MLA in his petition before the single judge had challenged the Centre's July 8 notification appointing Tanwar as the NDMC VC and sought cancellation of his appointment.
He has claimed that "he is aggrieved by the biased and illegal action of the respondents (Centre, NDMC, Tanwar and Delhi government) in appointing Karan Singh Tanwar as Member and Vice Chairperson of the NDMC in a prima facie biased manner in blatant and utter disregard of the procedure prescribed under section 4 of NDMC Act."
The appointment has been made without "occurrence and consultation" of Delhi Chief Minister Arvind Kejriwal, the plea has alleged.
The single judge had issued notice to all respondents and sought their response within two weeks.
