A 30-year-old owner of placement agency has been sent to 10 years in jail by a fast track court for raping a girl after confining her in his house.
Additional Sessions Judge M C Gupta gave the jail term to Rohini resident Mukesh Khanna for raping, threatening and confining a 20-year-old girl, brought here from Orissa on the pretext of meeting her 'sick' sister who was employed as a maid through the convict's agency.
According to the girl, after she was brought here by the convict's wife, she was not allowed to meet her sister and was forced by the couple to work as a maid.
The court rejected the contention of Khanna's counsel that there were no fresh injuries over the victim's body which showed she was a "consenting party" to the physical act.
"I have carefully perused and analysed the evidence on record. The victim girl has specifically deposed in her examinationinchief that she was unwell. Her condition was so bad that she was carried by the accused to a room at first floor, whereupon her rape was committed by him after removing her clothes and her mouth was also gagged.
"From such a weak, feeble, unwell girl what struggle can be expected to ward off the lustful attack of the accused. In the circumstances, there is no substance in the plea so raised by the counsel for the accused," the judge said.
According to the prosecution, in August 2010, when Khanna's wife had gone out, the girl was resting in a room as she was unwell and the accused came there and took her to another room where he raped her.
He had confined the victim for two days in his house and had also threatened that she will be killed if she disclosed anything about the incident, the police said, adding that on getting an opportunity, she escaped from the house and approached a neighbour who called the police.
During the trial, Khanna had claimed that he was falsely implicated in the case and sought leniency saying he has to support his family.
