In what could be an unprecedented move, Rajasthan Assembly today rejected the leave application of a BSP MLA wanted in a chit fund fraud case in Madhya Pradesh by voice vote.
B L Kushwaha, BSP MLA from Dholpur, had sought leave from the House from July 20 to August 1, 2014 for "business reasons".
The matter was brought to notice at the beginning of Zero Hour by Speaker Kailash Meghwal, who told the members that Kushwaha had applied for leave and sought the view of the House following which a number of ruling BJP Legislators sought to know the reasons for Kushwaha's absence.
BJP MLA, Ramhet Yadav demanded that the BSP MLA be brought to the House, "and there should be a probe on the charges, whether is he accused in the cases in Madhya Pradesh."
Senior BJP MLA G S Tiwari asked the Speaker to clarify the reason of MLA's leave to which he said the member wanted it for "business reasons".
Amid noisy scene, Chief Whip Kalulal Gurjar asked the Chair that the member should not be given leave.
Immediately, Meghwal sought a voice vote on the issue,. following which he announced that the House has rejected Kushwaha's plea.
Kushwaha, in February this year, was detained by police when he came to take oath at the Assembly in Jaipur, but armed with an anticipatory bail from Rajasthan High Court he was released the same night.
The Dholpur MLA had not attended the first session of the Assembly to take oath fearing police action.
As the 60-day period to take oath was about to over, the MLA approached the Rajasthan High Court for anticipatory bail which was granted.
Next day Kushwaha took oath in Speaker's chamber.
Madhya Pradesh police had been looking for the MLA since January 21 for his alleged involvement in a chit fund fraud case.
A single bench of Rajasthan High Court granted him transit bail for a period of seven days to appear before the Madhya Pradesh High Court.
