After failing to get bail from the lower court, suspended deputy superintendent of police Tarun Barot, who is behind the bars in the Sadiq Jamal fake encounter case, today moved the Gujarat High Court.
On December 1 the special CBI court here had rejected his bail plea on the ground that as per the charge-sheet, he was involved in the execution of encounter.
Justice A S Dave is likely to hear his bail plea on December 18.
Sadiq Jamal, a youth from Bhavnagar, was killed in an encounter by the Gujarat police near Galaxy Cinema in Naroda area of the city on January 13, 2003.
However, Ketan Tirodkar, a former journalist, said in his affidavit before a court in Mumbai that he was present when Jamal was handed over to the Gujarat police by the 'encounter specialist' officer Daya Nayak of Mumbai police. This happened a few days before the alleged encounter, he said.
The High Court ordered a CBI probe upon a petition of Shabbir Jamal, Sadiq's brother. CBI concluded that the encounter was fake and filed a charge-sheet in December 2012.
The charge-sheet names Barot, inspectors Jaysinh Parmar, I A Saiyad and Kishor Vaghela, sub-inspectors R L Mavani and Ghanshyamsinh Gohil and constables Ajaypalsingh Yadav and Chhatrasinh Chudasama.
