The Supreme Court today refused a plea for a stay on upcoming Xth and XIIth Board examinations in Jammu and Kashmir in view of the situation arising from the floods last year saying that the state government will take a decision on mass promotion of students to higher classes.
"We cannot stay the board examinations," the social justice bench comprising justices Madan B Lokur and U U Lalit said.
The bench's observation came when lawyer Vasundhara Pathak Masoodi, who has filed one of the PILs on the situations arising out of massive flood in the state, sought a stay on the board examinations on the ground that students have suffered a lot due the tragedy.
She said that students deserve mass promotion to higher classes.
"We have heard that there will be a popular government in the state in a week's time. They can take care of the issue," the bench said while adjourning the hearing for three weeks.
Earlier, the state government had told the court that it has postponed the annual examinations for classes I to VIII and will have to "impress upon" the state education board for taking the same step for students of class IX to XII.
The bench is hearing PILs including those filed by senior advocate and Jammu and Kashmir National Panthers Party chief Bhim Singh and Masoodi. They have sought proper rehabilitation and other facilities for the flood victims.
