The Madras High Court has ruled that once component system was applied for declaring examination results in the first year, students could not be compelled to take up examination under composite system in the final year.
Justice K.Ravichandrababu gave the ruling while allowing a petition by Anjana S Nair, an MDS (Orthodontics) student of Mookambika Institute of Dental Sciences affiliated to the Tamil Nadu M.G.R.Medical University, seeking a direction to the institute to declare her result as pass.
The petitioner had cleared her first year examination under the component system in 2012 when it was introduced. She was under the impression that it would continue for the final year also. However it was removed by the Standing Academic Board in December, 2013 and replaced by composite system from April, 2014.
She had passed the theory papers in April 2014, but failed in practicals and officials insisted that she should appear for theory, practical and vivavoce again in October, 2014.
In the examination, she cleared the viva voce and practicals but failed in theory.
The petitioner had passed theory in April, 2014 and as she joined the course under component system, she has to be declared pass after having cleared the practical and vivavoce in October 2014, the Judge ruled.
