Madras High Court today directed its registry to summon the entire files relating to former Additional Director General of Police M S Jaffar Sait, now under suspension, from Special Judge for Prevention of Corruption Act, who issued summons to him in a corruption case.
On a petition filed by Sait to quash the summons, Justice K K Sasidharan also ordered issue of notice to Public Prosecutor of the State and Central Governments, Senior Standing Council for Centre and directed the High Court registry to place the file before it by tomorrow and posted the matter for hearing to Friday.
The Directorate of Vigilance and Anti-Corruption had registered corruption cases against Sait, his wife and elder daughter following complaints of allotment of plot under Government Discretionary Quota.
After the case was registered Sait was suspended in August 2011.
The DVAC had submitted its final report regarding the case before the Court of Special Judge for Cases under Prevention of corruption Act.
After the report was received, the Special Judge on October 8 issued summons to Sait directing him to appear before the Judicial Magistrate, Ponneri, on 28th October.
Sait challenged the issue of summons maintaining that he, being an officer governing All India service Rules, a statutory sanction was required for the prosecution of him under the Provisions of Section 19 of PCA from Union of India.
