Kerala HC upholds stay on commission to probe ED role in gold smuggling

The Kerala High Court on Friday upheld its 2021 single judge decision to stay a state government order appointing a Commission of Inquiry (CoI) to examine any alleged attempt by the Enforcement Directorate (ED) to implicate Chief Minister Pinarayi Vijayan in the gold smuggling through diplomatic channels case. A bench of Justices Sushrut Arvind Dharmadhikari and Syam Kumar V M said there was no error in the single judge's August 11, 2021, interim order. The bench's ruling came while dismissing the Kerala government's appeal challenging the single judge's order. "The Writ Appeal, being bereft of merit and substance, is hereby dismissed. The interim order dated August 11, 2021, passed by the single judge is affirmed," the bench said. The single judge's order had come on a plea by the Enforcement Directorate (ED) seeking to quash the state government's notification regarding the appointment of the CoI. The bench also said the issue of the state government's legislative competence to

Delhi Court allows CBI to close Najeeb Ahmed case, cites lack of evidence

A Delhi court on Monday allowed the CBI to close the case of first year JNU student Najeeb Ahmed, who went missing on October 15, 2016, saying the agency "exhausted all options". Additional chief judicial magistrate Jyoti Maheshwari also "earnestly hoped" Najeeb was traced soon. "This court expresses its regret that while the proceedings in the present case end with this closure report, a closure for Najeeb's mother and other loved ones, still eludes us," the order said. While it accepted the agency's closure report, the court granted liberty to the CBI to re-open the investigation on the receipt of any credible information on Ahmed's whereabouts and intimate the court accordingly. The judge said there was no evidence of any scuffle or exchange of Najeeb with any person on the day of his disappearance once he returned to the hostel to show his disappearance was caused by any suspect or any other person at JNU. "An analysis of the discussion shows that CBI has undertaken a holistic

Robert Vadra skips ED summons in PMLA case linked to Sanjay Bhandari

Robert Vadra, the businessman husband of Congress MP Priyanka Gandhi Vadra, on Tuesday skipped an ED summons for questioning in a money laundering case linked to UK-based alleged arms consultant Sanjay Bhandari, official sources said. The sources said Vadra sought an adjournment of Tuesday's summons, and he will now be given a fresh date. The ED wants to record Vadra's statement under the Prevention of Money Laundering Act (PMLA) and then file a chargesheet against him before the court, sources said. The federal probe agency had questioned the 56-year-old businessman for three consecutive days in April in a separate money laundering case linked to alleged irregularities in a 2008 land deal in Haryana. Bhandari (63) fled to London in 2016, soon after the Income Tax Department raided him in Delhi. A UK court earlier this month refused an application filed by the Indian government seeking permission to appeal in Britain's Supreme Court against the discharge of Bhandari in an extradi
