Cong turned SCs, STs, OBCs to second-class citizens: PM on Ambedkar Jayanti

Prime Minister Narendra Modi on Monday launched a scathing attack on the Congress on the birth anniversary of B R Ambedkar, accusing the party of turning Scheduled Castes, Scheduled Tribes and OBCs into "second-class citizens" while in power. Addressing a gathering after flagging off the first commercial flight from the Maharaja Agrasen airport here to Ayodhya and laying the foundation stone of a new terminal building at the airport, he alleged the Congress has become the destroyer of the Constitution framed by Ambedkar. The Congress "crushed" the Constitution whenever its government faced danger, Modi alleged and pointed to the 1975-77 Emergency to reinforce his claim. "The spirit of the Constitution is to have a uniform civil code, which I call a secular civil code. But the Congress never implemented it." He referred to the implementation of the Uniform Civil Code by the BJP government in Uttarakhand to say, "See the misfortune of this country. Those who carry a copy of the ...

Incident didn't happen in public view: SC quashes case under SC-ST Act

The Supreme Court on Friday quashed a case against a man booked under the SC/ST Act saying the alleged incident did not happen in public view. A bench of Justices B R Gavai and Augustine George Masih said Section 3(1)(r) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, reveals for an offence to occur, it had to be established that the accused intentionally insulted or intimidated a member of either a SC or ST with the intent to humiliate in a place within public view. In addition, it said for constituting an offence under Section 3(1)(s) of the Act, it would be necessary that the accused abused any member of a SC or ST by caste name in any place within public view. "We are, therefore, of the considered view that since the incident has not taken place at a place which can be termed to be a place within public view, the offence would not come under the provisions of either section 3(1)(r) or section 3(1)(s) of the SC-ST Act," held the bench. Section

Wankhede, the additional commissioner in the Directorate General of Taxpayer Services (DGTS) and a member of the Mahar Scheduled Caste, last week moved the HC seeking the case to be transferred to the CBI, alleging inaction by the police. A division bench of Justices Revati Mohite Dere and Prithviraj Chavan directed for Mumbai's Goregaon police station's officer concerned to remain present on the next date along with the case diary. The court said it shall be apprised of the details of the investigation in two weeks.
