The appeal was moved by a developer of residential colonies, Macro Marvel Project Ltd, challenging the power of the Tamil Nadu government to acquire 583 hectares in Kanchipuram district for a new runway.

The firm had also bought land for constructing residential townships. The Airports Authority of India wanted to expand the airport and had approached the central government for land.

Therefore, the construction firm moved the court arguing that the Tamil Nadu Acquisition of Lands for Industrial Purposes conferred the state government power to acquire land only for industrial purposes, not for airport.
