Former Pakistani president General Pervez Musharraf has reportedly filed a petition in the Supreme Court, challenging the Special Court's decision of conducting the high treason trial against him instead of referring it to a military court.
Musharraf had filed an application seeking trial by a military court under the Pakistan Army Act (PAA) 1952, which was dismissed by the special court on Feb 21.
According to Dawn, the rejection was earlier challenged in the Islamabad High Court which on March 19 ruled that only the Supreme Court had the jurisdiction to decide the matter.
In the petition, Musharraf argued that applying the rule of consistency and taking protection under Article 25 read with Article 4 of the Constitution, the petitioner's case should have been sent to the military court.
Musharraf said that the governments many times act in disregard of constitutional provisions and so do the members of the judiciary, adding that a government cannot be arraigned by a subsequent government under Article 6 on that account.
