HC to hear arguments on maintainability of plea against Himachal CM

The Delhi High Court on Wednesday said it would hear arguments on December 3 on the maintainability of plea for a court-monitored probe into charges against the Himachal Pradesh Chief Minister Virbhadra Singh.

A division bench of Justice B.D. Ahmed and Justice Sanjeev Sachdeva said senior advocate Hariharan who was appointed amicus curiae in the case will start arguments in maintainability of the plea.

"On the submissions led by advocate Kapil Sibal (appearing for Singh) we are reopening the issue of maintainability. Advocate Hariharan shall argue on the issue of maintainability on December 3," said the court.

The court's order came after Sibal argued that a court-monitored probe into charges against the chief minister was not maintainable.

The court earlier held that the plea was maintainable, saying when the court itself ha d taken up the issue on its own, there was no question of maintainability.

However, Sibal said an FIR has already been registered against Singh and investigation has been going on, matter is related to Himachal Pradesh, so the plea was not maintainable and there was no need of court-monitored probe.

Hariharan told the bench that CBI had filed a plea in the Supreme Court seeking the transfer of disproportionate assets case outside Himachal Pradesh.

The CBI and the Income Tax department had earlier filed status rep ort on the allegations against Singh in a disproportionate assets case.

There are charges against Singh on amassing assets disproportionate to his known sources of income.

Earlier, a public interest litigation on the issue was filed by a non-governmental organisation, Common Cause, but Singh challenged its maintainability.

The court later discharged the NGO and Prashant Bhushan, appearing for the NGO, from the matter and appointed advocate Hariharan as amicus curiae to assist the court on the issue.
