The Supreme Court on Thursday stayed the summons issued by an Uttar Pradesh court to Delhi Chief Minister Arvind Kejriwal and AAP leader Kumar Vishwas and issued a notice to the state government.
A bench headed by Justice Jagdish Singh Khehar granted the stay on the summons issued by a Sultanpur court in a case wherein both leaders were accused of violating prohibitory orders by holding an unscheduled roadside meeting during the 2014 Lok Sabha election.
Both Aam Aadmi Party leaders sought the quashing of the criminal proceedings that followed the FIR filed by an Assistant Election Officer on April 20, 2014.
In pursuance to the summons, Kejriwal and Vishwas were to appear before the Sultanpur court on Thursday.
Earlier, the Lucknow bench of the Allahabad High Court declined their plea against the court summons.
Dismissing their plea, the High Court said on October 24: "For the facts and circumstances mentioned above, I do not find any sufficient ground to interfere in the present matter. I also do not find any sufficient ground to quash the entire criminal proceedings. The petition lacks merit, and deserves to be dismissed."
