CCI rejects complaint against Tata Housing Development

The Competition Commission has dismissed allegations of abuse of dominant position against realty firm Tata Housing Development Co Ltd (THDCL) with regard to sale of a flat in Pune.
The complainant had purchased a flat in Inora Park -- a project developed by the realty firm in Pune.
Among others, it was alleged that the buyers were manipulated and tricked into signing an unread agreement of sale with unfair and unacceptable terms and conditions.
The complainant had also challenged various clauses of the buyers agreement with regard to the price of flat, sale of car parking, etc, as being one sided, ambiguous and uncertain.
For the case, the Competition Commission of India (CCI) considered "market for the provision of services relating to development and sale of residential flats in Pune city" as the relevant one.
In a recent order, the regulator opined that THDCL faces "sufficient competitive constraints" from various other builders in the relevant market.
Upon finding that THDCL is "not in a dominant position in the relevant market", the CCI said that the issue of alleged abuse of dominant position against the realty firm does not survive.
