Court asks for impartial probe in molestation case against cop

A court here has directed the Delhi Police to carry out an "impartial" investigation into a molestation case filed by a woman against a constable while rejecting a cancellation report saying that the probe was not done properly.
Metropolitan Magistrate Vandana Jain directed the DCP of the concerned area to assign the investigation to a reliable official in the case in which the cancellation report was filed by the Investigating Officer (IO).
"The lapses in the investigation go to the root of the matter and have to be rectified. Therefore, it is necessary that an impartial investigation is carried out.... Hence protest petition is allowed and the concerned DCP is directed to assign further investigation to some competent official so as to elicit the truth," the magistrate said.
"Since the investigation has not been carried out in the manner provided under the sections of the CrPC, the present cancellation report cannot be taken into consideration," the court said.
The court was hearing a protest petition filed by a woman against the cancellation report of the IO on her complaint filed in Shakarpur Police Station against Constable Ranbir Singh for allegedly outraging her modesty.
As per the petition, the woman's complaint against Singh was declared false by the IO, who then filed a cancellation report in it and said that the woman had falsely implicated the constable.
The IO in his report had said that the complaint was false and fabricated and no grounds were made out against the cop to make him face trial in this case, it said.
The IO in the report had alleged that the woman herself was carrying out immoral trafficking at her house and she had threatened to implicate Singh in a false case.
Aggrieved by the report, the woman filed the protest petition against it in the court alleging that the probe was "botched up" by the IO.
"The investigation is faulty and procedure followed during the investigation is illegal and, therefore, the investigation carried out by IO is not sustainable in the eyes of law.
"The woman had given a different version which was not recorded by IO in verbatim and he has manipulated the complaint made by the complainant (woman) in order to save his colleague," the petition said.
The petition said the allegations made in the complaint have been "suppressed and diluted" and the cancellation report was filed in connivance with the accused constable.
The woman had prayed for further investigation in this matter by some independent agency.
