Court dismisses plea against BJP leader Shahnawaz Hussain

A plea seeking registration of an FIR against BJP leader Shahnawaz Hussain for allegedly being involved in a textile scam has been dismissed by a Delhi court which slapped a fine of Rs 25,000 on the complainant saying the petition was filed with "ulterior political motives".
Additional Sessions Judge (ASJ) Dharmesh Sharma said the petition deserved to be "thrown away" as it has been filed for "publicity" and has wasted valuable time of the court.
"... Complaint manifestly appears to be blatantly misconceived and ill conceived in law tainted with ulterior political motives...
"It is unfortunate that the petitioner being a lawyer is venturing into this kind of publicity stunt and has wasted the valuable time of the court at huge cost to the exchequer," the court said and upheld the order of a magistrate who had also rejected a similar plea of advocate S K Singh.
Singh had approached the sessions court challenging the magistrate's order, saying that his complaint was dismissed in a "mechanical manner" contrary to law.
Singh had sought lodging of an FIR against Hussain, his brother Shahbaz and some others for allegedly being involved in a textile scam during 2004-2012, in pursuance to a conspiracy at Bhagalpur in Bihar.
He had alleged that Hussain and others had acquired assets of over Rs 200 crore and after he had exposed these irregularities, he was given "death threats" in March and April this year.
The complainant has alleged that the BJP leader and others had taken a huge bribe from contractors in Bhagalpur for construction of some bridges and roads under the 'Pradhan Mantri Gram Sadak Yojana' and other schemes.
