DIAL seeks dismissal of plea seeking CBI probe in HC

Delhi International Airport Ltd (DIAL) today urged Delhi High Court to dismiss a plea seeking direction to CBI to lodge a case on "alleged bungling" in the leasing of around 5000 acres of prime land of Delhi airport to private companies for modernisation.
"Maintainability of the plea seeking direction to CBI on alleged illegalities and irregularities on the basis of CAG report has already been dismissed by the division bench (of this court) in the negative," DIAL submitted before a bench of Chief Justice G Rohini and Justice Jayant Nath.
In its affidavit, it said the "petitioner has after eight -and-half-years preferred application for revival of the writ petition contending that as the Supreme Court has now decided the matter on account of which the writ petition was adjourned sine die, the writ petition should be revived now."

"The attempt by the petitioner to revive the present application on the basis of CAG report is patently illegal and not maintainable as it offends the constitutional mechanism of the country," DIAL said, adding that the petition was solely based on the CAG report.
DIAL was responding to the fresh application filed by an NGO seeking revival of the case, which was disposed of in July 2006.
Intially the court has refused to entertain the matter, as the issue relating to the award of contract in question was agitated before the Supreme Court.
The court, however, agreed to hear the matter after being informed that by a July 20, 2006 order of this court, the parties were granted liberty to revive it once the matter pending before the apex court was disposed of.

The petitioner Rashtriya Mukti Morcha (RMM), through a fresh application, has sought direction to CBI to register a regular case against former Civil Aviation Minister Praful Patel and officials of Airport Authority of India (AAI) and the GMR-led Delhi International Airport Limited (DIAL).
