Drunk driving: Court reduces sentence after convict repents

A sessions court here has allowed the plea of a man against a two-day jail term awarded to him by a magistrate for drunken driving, considering that he had never been prosecuted for traffic violation earlier and had assured it that he would not repeat the offence.
Additional Sessions Judge Sudesh Kumar, while taking a lenient view towards the 29-year-old convict, who was held guilty under Motor Vehicles Act for riding his two-wheeler in drunken condition, sent him to TRC (Till Rising of the Court).
"Considering the facts that the appellant was driving his personaltwowheeler, hasneverearlier been prosecutedfor traffic violation,the fact that he has already faced rigors of the trial andalsotheundertakinggivenbyhimneverto indulgein any such activity, a lenient view is taken and instead of simple imprisonmentfortwodays, heis sentenced toTRC(tillrisingof Court)," the judge said.

The court, however, refused to interfere with the fine of Rs 4,000 imposed on the convict by a magisterial court.
According to police, on March 23, 2016, the man, who is a south-Delhi resident, was riding his vehicle and was stopped near Chirag Delhi flyover by traffic personnel.
He was tested with breath analyser and the alcohol content was found more than the permissible limit. He was challaned and produced before a magisterial court which awarded him two days' jail term and fine.
Challenging the sentence, the convict, who was working as a manager in a travel agency, contended before the sessions court that he was young and in case he undergoes jail term, he would lose his job and the social stigma would affect his future prospects.

He also gave an undertaking that he would not indulge in unlawful activity in future.
