The Madras High court today directed Bar Council of Tamil Nadu to file an affidavit in four weeks on the steps taken to bring down the enrollment of persons with criminal background as advocates.
The first bench, comprising Chief Justice Sanjay Kishan Kaul and Justice T S Sivagnanam, stated this while passing interim orders on a petition by one M A Balasubramanian, former Chief Manager of Bank of India, who was removed from service for alleged irregularities, seeking a direction to the Council to enroll him as an advocate.
The bench recorded submission of Bar Council of India that a sub-committee had been constituted to look into various issues on qualifications for being enrolled as lawyers as also necessary checks and balances and directed the State Bar Council to file an affidavit within four weeks.
The bench also recorded the statement of the state Bar Council that steps had been taken to bring down enrollment of persons with criminal background as its members.
The petitioner submitted he was working in Bank of India as Chief Manager and was removed from service for alleged gross violation of norms, exposing the bank to the huge risk of Rs 145 crore.
Balasubramanian said he would like to practice as an advocate, sought to be enrolled and said he filed this petition on not getting a response from the Bar Council.
The bench posted the matter for further hearing to August 21.
