The order was passed by a larger bench of Justices Devi Prasad Singh, Ajay Lamba and Ashwani Kumar Singh on a PIL filed by a local lawyer Ranjana Agnihotri and five others.
Seeking details and status of such cases, the court fixed August 29 as the next date of hearing allowing petitioner and respondents to submit their submission by August 23.
The court directed the Principal Secretary (Home) to file the order along with an affidavit.
The order was passed by the bench of Justice Rajeev Sharma and Justice Mahendra Dayal, which also referred the matter to a larger bench.
The petitioners had sought direction for quashing the order issued by the state for withdrawing cases against persons accused of alleged terror activities and serial blasts.
They prayed to strike down Section 321 as ultra vires to Article 14 of the Constitution and also declare it as unconstitutional on the ground that it affects sovereignty, integrity and internal security of the country, petitioners have also challenged the validity of section 321 of the CrPC (provision for withdrawing the cases).
