A sessions court here today convicted a man for causing the death of a woman commuter of a local train by hitting her with a rod to steal her belongings and awarded him ten-year imprisonment.
"The court has convicted Rajesh Kumar Singh and sentenced him to imprisonment for ten years", said public prosecutor Vijay Malvankar.
The court of Judge D G Murumkar also imposed a fine of Rs 5000 on Singh and directed that the amount be given to the victim's son.
According to the prosecution, the incident had occurred on January 23, 2011 when the victim, Daksha Gugal and her eleven-year-old son were travelling in a local train on the Central Line.
When the train left Sion station, Gugal stood near the door of her compartment and was speaking over phone when Singh, who was on a electric pole adjacent to the track, hit her with a stick and rope, following which she lost her balance and fell on the opposite track and run over by another train passing by. Singh decamped with her jewellery and mobile phone.
Gugal succumbed to her injuries 10 days later.
Kurla Railway Police registered a case against an unnamed person after Gugal's co-passengers alerted them and later arrested Singh on the basis of IMEI number of the mobile phone.
He was booked under relevant sections of IPC including section 302 (murder), besides under Railway Act.
The prosecution examined 11 witnesses to prove its case while Singh was provided a lawyer by the court from Legal Aid.
Singh's lawyer V B More said that the court convicted him under sections 394 (voluntarily causing hurt in committing robbery), 397 (robbery or dacoity with attempt to cause death or grievous hurt) under the IPC and section 153 (endangering safety of persons travelling by railway by wilful act or omission) of the Railway Act.
