A PIL seeking a direction to hand
over the investigation into terror attacks in Tamil Nadu to the National Investigation Agency was today dismissed as withdrawn by the Madras High Court.
The plea was filed by S.Subramaniam Balaji, an advocate.
When the matter came up before a division bench comprising Justice N. Paul Vasanthakumar and Justice R. Mahadevan, they posed several questions to the petitioner including that of the allegations made in the affidavit by him that innocent people were arrested in some murder cases.
The bench asked the petitioner how he can file an affidavit when the cases are under investigation and then asked him whether he would like to withdraw or the bench will pass necessary orders.
Then petitioner submitted he would like to withdraw his plea and the bench recorded it and dismissed the petition.
Listing the attacks and murders of leaders of Hindu organisations in the state, the petitioner had alleged the state police do not seem to understand the dimensions of national security and threats thereof.
The first bench, comprising Chief justice R.K.Agrawal and Justice M.Sathyanarayanan, had yesterday directed the court Registry to post the PIL before some other bench.
