Rash driving:Kin of 28-yr-old youth get Rs 13.72L compensation

Family members of a 28-year-old youth, who was killed in a road accident involving a rashly driven bus, have been awarded a compensation of over Rs 13 lakh by a Motor Accident Claims Tribunal (MACT) here.
MACT Presiding Officer Harish Dudani directed Oriental Insurance Company Ltd, insurer of the offending bus, to pay Rs Rs 13.72 lakh as compensation to the wife and father of one Satish Kumar Sain, who died in 2013.
While holding the driver of the bus guilty of negligent driving, the tribunal relied on the testimonies of the victim's wife Pooja and an eyewitness and documents submitted by them including the copies of FIR and post mortem report.
"In view of testimony of victim's wife and documents on record the negligence of driver of offending vehicle has been prima facie proved," the court said.
According to the petition, on October 1, 2013, Sain was crushed under the rashly and negligently driven bus while he was crossing Pandara Road near India Gate here.
He was taken to RML Hospital where he was declared brought dead, it said.
The driver in his statement had claimed that the accident took place due to negligence on the part of deceased himself.
The insurance firm, however, had filed offer of settlement and had offered Rs 11.54 lakh as compensation.
